# Terms of Service

## Welcome to GokovaWind

These Terms of Service ("Terms") govern your use of the GokovaWind mobile application ("App") operated by GokovaWind ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

## 1. Acceptance of Terms

By accessing or using GokovaWind, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.

## 2. Description of Service

GokovaWind provides real-time wind and weather data from our weather station located at Gökova Bay, Turkey. The App offers:

- Real-time wind speed and direction

- Temperature and weather conditions

- Weather forecasts

- Optional premium features including:

  - Ad-free experience

  - Custom wind and rain alerts

  - Map view with satellite imagery

  - Customizable unit preferences

  - News and updates about the spot and kitesurfing community

## 3. User Accounts and Registration

Currently, GokovaWind does not require user registration or account creation. You can use the App without providing personal information.

## 4. Premium Subscription

### 4.1 Subscription Plans

We offer the following subscription options:

- Weekly subscription

- Monthly subscription

- Annual subscription

### 4.2 Payment Terms

- Payment will be charged to your Apple ID account at confirmation of purchase

- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period

- Your account will be charged for renewal within 24 hours prior to the end of the current period

- You can manage and cancel subscriptions in your Apple ID account settings

### 4.3 Free Trial

If we offer a free trial period, you will be charged the subscription fee once the trial ends unless you cancel before the trial period expires.

### 4.4 Refund Policy

All purchases are subject to Apple's refund policy. For refund requests, please contact Apple Support directly.

### 4.5 Legacy Users

Users who purchased the App before the introduction of subscriptions (versions 1.0 through 4.2, purchased before February 6, 2026) are granted lifetime premium access without requiring a subscription.

## 5. Use of the App

### 5.1 Permitted Use

You may use the App for personal, non-commercial purposes to:

- Access weather information

- Receive notifications about wind conditions

- Plan water sports activities

### 5.2 Prohibited Use

You agree NOT to:

- Use the App for any illegal or unauthorized purpose

- Attempt to gain unauthorized access to the App's servers or systems

- Interfere with or disrupt the App's functionality

- Reverse engineer, decompile, or disassemble the App

- Use the App to transmit malware, viruses, or harmful code

- Resell, redistribute, or commercially exploit the App's content

- Use automated systems (bots, scrapers) to access the App

## 6. Weather Data Disclaimer

### 6.1 Accuracy and Reliability

While we strive to provide accurate and up-to-date weather information:

- Weather data is provided "AS IS" without warranties of any kind

- We do not guarantee the accuracy, completeness, or reliability of weather data

- Weather conditions can change rapidly and unpredictably

- Our weather station equipment may experience technical issues or downtime

### 6.2 Safety Warning

**IMPORTANT SAFETY NOTICE:**

- Weather data is for informational purposes only

- Do NOT rely solely on this App for safety-critical decisions

- Always use multiple sources of weather information

- Water sports and outdoor activities carry inherent risks

- Always check official weather forecasts and warnings

- Never engage in water sports beyond your skill level

- Always wear appropriate safety equipment

- Follow local regulations and safety guidelines

## 7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

### 7.1 No Warranty

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

- Merchantability

- Fitness for a particular purpose

- Non-infringement

- Uninterrupted or error-free operation

### 7.2 Disclaimer of Damages

We shall not be liable for any:

- Personal injury or property damage

- Loss of profits or revenue

- Loss of data or information

- Indirect, incidental, special, or consequential damages

- Damages arising from your use of or inability to use the App

- Damages resulting from reliance on weather data provided by the App

### 7.3 Maximum Liability

Our maximum liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the App or subscription in the past 12 months.

## 8. Intellectual Property

### 8.1 Ownership

All content, features, and functionality of the App, including but not limited to:

- Software code and architecture

- User interface design

- Graphics, logos, and icons

- Text and documentation

- Weather data compilation

are owned by GokovaWind and protected by international copyright, trademark, patent, and trade secret laws.

### 8.2 License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

### 8.3 Trademarks

"GokovaWind" and related logos are trademarks of GokovaWind. You may not use these trademarks without our prior written permission.

## 9. Third-Party Services

The App may contain links to third-party websites or services, including:

- Apple App Store

- Weather data providers

- Map services

- Advertising networks (for non-premium users)

We are not responsible for the content, privacy practices, or terms of third-party services.

## 10. Advertisements

### 10.1 Free Version

The free version of the App is supported by advertisements. By using the free version, you agree to view advertisements.

### 10.2 Ad-Free Experience

Premium subscribers receive an ad-free experience without third-party advertisements.

## 11. Privacy and Data Collection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you also agree to our Privacy Policy.

## 12. Push Notifications

If you enable push notifications, you consent to receive:

- Wind condition alerts

- Rain alerts

- App updates and news

- Other relevant notifications

You can disable notifications at any time in your device settings.

## 13. Modifications to the App

We reserve the right to:

- Modify or discontinue any feature of the App

- Update the App's functionality

- Change subscription pricing with advance notice

- Temporarily or permanently suspend the App

We will make reasonable efforts to notify you of significant changes.

## 14. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by:

- Updating the "Last Updated" date at the top of these Terms

- Providing an in-app notification

- Sending an email if we have your contact information

Your continued use of the App after changes constitutes acceptance of the revised Terms.

## 15. Termination

### 15.1 Your Rights

You may stop using the App at any time by deleting it from your device. Subscription cancellations must be done through your Apple ID account settings.

### 15.2 Our Rights

We reserve the right to:

- Suspend or terminate your access to the App

- Refuse service to anyone

- Remove or disable access to the App

for any reason, including violation of these Terms.

### 15.3 Effect of Termination

Upon termination:

- Your right to use the App immediately ceases

- Subscription fees are non-refundable except as required by law

- Provisions that should survive termination (including disclaimers and limitations of liability) will remain in effect

## 16. Geographic Restrictions

The App is provided from Turkey and intended for use in Turkey and internationally. We make no claims that the App is appropriate or available for use outside of Turkey. If you access the App from other locations, you do so at your own risk and are responsible for compliance with local laws.

## 17. Governing Law and Jurisdiction

### 17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

### 17.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Turkey, Muğla Province.

### 17.3 Waiver of Class Actions

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

## 18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

## 19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GokovaWind regarding the App and supersede all prior agreements and understandings.

## 20. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

## 21. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:

- Natural disasters

- Acts of war or terrorism

- Internet service disruptions

- Power outages

- Equipment failure

- Government actions

## 22. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
